Terms & Conditions – Dr. Martens Social Media #DMsChallenge Competition April 2024 (the “Competition”).

a) NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. By participating in the Competition, you (i) agree to be bound by these Terms and Conditions, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Promoter (as defined below), which are final and binding in all matters relating to the Competition.

b) Airwair International Ltd (registered company no. 03009359) whose registered office is at Cobbs Lane, Wollaston, Northamptonshire NN29 7SW (“the Promoter”) is the Promoter of the Competition.

c) Entrants must follow all the online instructions to be eligible to enter and win. To be eligible entrants must share an image or video related to Dr. Martens based on the theme publicised on the Dr. Martens official Instagram, Facebook and Twitter channels (“the Theme”). The image or video must be shared on Instagram using #DMsChallenge and tagging @drmartensofficial, or shared on Facebook or Twitter in the ‘Comments’ section of the competition post to enter. Entry into the Competition is not conditional on providing a specific image or video and every entrant that complies with the instructions is eligible to enter. Accounts must be public for the duration of the Competition so that the Promoter can contact the winning entrant(s).

d) Other than in a Tie Situation (defined below), one pair from the Dr. Martens’ product line (excluding accessories and items in any collaboration range) will be given away up to the value of £200 to one (1) entrant.

e) Entries will be judged by the Dr. Martens marketing team based upon the following criteria (the “Criteria”): (1) creativity and originality, (2) quality and execution, (3) adherence to the Theme and Dr. Martens’ stylings, and (4) overall impression. An independent judge will oversee the process to ensure that the Competition process is operated fairly and that all entries are assessed in accordance with the Criteria. After assessing the entries against the Criteria, the marketing team and the independent judge will select a shortlist (the “Shortlist”) comprising their chosen top 3 entries. The Promoter’s decision on which entries comprise the Shortlist is final.

f) The Shortlist entries will be shared via the Dr. Martens official Instagram stories page by 12/05/24. The entrant whose entry receives the most “votes” on the story once it expires will be determined to be the winning entrant (the “Winner”). The Promoter’s determination of the Winner using this method is final. Entrants agree that their entry may be shared via the official Dr. Martens Instagram story if they make it to the Shortlist.

g) One (1) entry per person. Competition begins at the time it is announced on the Dr. Martens official Instagram, Facebook and Twitter page on 14/04/24. Entries will be accepted up until 11:59pm (GMT) on 30/04/24.

h) In the event that two or more entries in the Shortlist are tied for the most “likes” when the Winner is determined (a “Tie Situation”), any and all such entrants will be considered Winners. All Winners will therefore receive one pair from the Dr. Martens’ product line (excluding accessories and items in any collaboration range) up to the value of £200.

i) Winners will be contacted in accordance with paragraph l) below by no later than 11:59pm (GMT) on 19/05/24.

j) The prize is subject to sizing and colourways available. The Promoter will offer a redeemable voucher of £200 (or local currency equivalent) equal to the value of the prize should the correct size not be available. The prize is non-assignable and non-transferable except to a surviving spouse. Product is not for resale.

k) The Competition is open globally other than to residents of Italy. Entrants must be aged 18+ to be eligible.

l) Winners will be contacted via direct message on Instagram, Facebook or Twitter. If a winner fails to respond within three (3) calendar days the entrant in the Shortlist with the next most likes will be deemed the Winner. The deadline given in paragraph i) may be extended in such circumstances. If no entrants in the Shortlist respond within the timeframe required, there shall be no winner. The Promoter accepts no responsibility for incorrect or misspelt email contact information submitted by an entrant. No liability is accepted for entries that cannot be counted for any technical reason.

m) Employees or agents of the Promoter, their family members, or anyone else connected with the Promoter may not enter the Competition.

n) The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside of its control. The decision of the Promoter in all matters under its control is final and binding. The Competition will be governed by the law of England and Wales.

o) The Promoter is not responsible if the Competition cannot take place or if the prize cannot be awarded due to cancellations, delays or interruptions due to acts of war (declared or undeclared), natural disasters, weather, acts of terrorism, riot or civil disturbance, satellite or equipment failure, federal state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within the Promoter’s control (each a “Force Majeure” event or occurrence).

p) Entry materials/data that have been tampered with or altered, or mass entries or entries or likes generated by a script, macro or use of automated devices are void. The Promoter is not responsible for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Promoter on account of technical problems or traffic congestion on the internet or at any web site or any combination thereof; or (ii) any injury or damage to persons or property, including but not limited to death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use of the prize, except where such liability cannot be excluded by applicable law.

q) Behaviour which is intended to disrupt or undermine the legitimate operation of the Competition, or which is intended to annoy, abuse, threaten or harass any other person, or any failure to comply with these Terms and Conditions, may result in disqualification from the Competition, and Promoter reserves the right to seek damages and other remedies from any such person engaging in such behaviour to the fullest extent permitted by law. The Promoter reserves the right to: (i) permanently disqualify from the Competition any person it believes has intentionally violated these Terms and Conditions; and (ii) cancel, suspend and/or modify the Competition without any liability if any fraud, virus or other factor beyond the Promoter’s reasonable control impairs the administration, functioning or proper play of the Competition, as determined by Promoter in its sole discretion, and withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Competition), and to select a winner from among all eligible entries received prior to withdrawal. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

r) The Competition is in no way sponsored, endorsed or administered by, or in association with, Instagram, Facebook or Twitter. Entrants are providing their information to the Promoter and not to Instagram, Facebook or Twitter and by participating in the Competition you agree to a complete release of Instagram, Facebook or Twitter from any claims.
