Terms & Conditions – Dr. Martens - Black Friday 2024 competition www.drmartens.com (the “Competition”).
a) NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. By participating in the Competition, you (i) agree to be bound by these Terms and Conditions, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Promoter (as defined below), which are final and binding in all matters relating to the Competition.
b) Airwair International Ltd (registered company no. 03009359) whose registered office is at Cobbs Lane, Wollaston, Northamptonshire NN29 7SW (the “Promoter”) is the organiser of the Competition.
c) Entrants must follow all the online instructions for the Competition to be eligible to enter and win. To be eligible entrants must complete the form on https://www.drmartens.com/uk/en_gb/black-friday-cyber-monday-offers or enter via paid social with their name and email address. It is optional for entrants to tick the box to subscribe to the Dr. Martens newsletter and entrants may unsubscribe at any time. Opting into our newsletter or other marketing emails (or choosing not to do so) will not affect an entrant’s chance of winning.
d) There is a maximum of one (1) entry per person. An individual may not win more than one prize, regardless of the number of entries they have submitted. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Entries will be accepted from 10:00am GMT on 11th November 2024 up until 10:00am GMT on 26th November 2024 . Entries received after that date and time will not be considered.
e) The prize for winning the Competition is: A Dr. Martens gift card to the value of £200 (the “Prize”).
f) The Prize will be allocated as follows: 1 (one) individual who has submitted a valid entry will be drawn at random from the pool of entries (the “Winner”). The draw will be held on 28 November at 9:00am GMT. Regardless of the number of entries, an individual may only win one Prize. Any personal tax obligation that arises as a result of the granting of the Prize will be the sole responsibility of the Winner and the Promoter will not be liable in respect of any such tax obligation. Entries which are defamatory, discriminatory, obscene, abusive, threatening or offensive in any way shall be excluded from the Competition. The Promoter’s decision is final.
g) Prize is non-assignable and non-transferable except to a surviving spouse. Prize is not for resale.
h) The Competition is open to entrants aged 18+ who are resident in the UK.
i) The Winner will be contacted via email no later than 10:59pm GMT on 28th November 2024. The Winner's email will include a coupon which can be exchanged for the Prize and will be valid for one year from the date it has been issued. If the Winner fails to respond by the deadline notified in the email, another Winner with a valid entry will be selected from the pool of entries. The Promoter accepts no responsibility for incorrect or misspelt contact information submitted by an entrant. No liability is accepted for entries that cannot be counted for any technical reason.
j) Each entrant’s details, which includes their first name and email address, shall be retained by the Promoter until 30th November 2024, after which it shall be deleted (unless the entrant has subscribed to the Promoter’s newsletter, in which case the Promoter shall retain the entrant’s full name and email address). Subject to the Winner’s approval, the first name and email address of the Winner will be available for 28 days after the closing of the competition by e-mail request to: [email protected].
k) Employees or agents of the Promoter, their family members, or anyone else connected with the Competition may not enter the Competition.
l) The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside of its control. The decision of the Promoter in all matters under its control is final and binding. The Competition will be governed by the law of England and Wales.
m) The Promoter is not responsible if the Competition cannot take place or if the Prize cannot be awarded due to cancellations, delays or interruptions due to acts of war (declared or undeclared), natural disasters, weather, acts of terrorism, riot or civil disturbance, satellite or equipment failure, federal state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within the Promoter’s control (each a “Force Majeure” event or occurrence).
n) Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Promoter is not responsible for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Promoter on account of technical problems or traffic congestion on the internet or at any web site or any combination thereof; or (ii) any injury or damage to persons or property, including but not limited to death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use of the Prize, except where such liability cannot be excluded by applicable law.
o) Behaviour which is intended to disrupt or undermine the legitimate operation of the Competition, or which is intended to annoy, abuse, threaten or harass any other person, or any failure to comply with these Terms and Conditions, may result in disqualification from the Competition, and Promoter reserves the right to seek damages and other remedies from any such person engaging in such behaviour to the fullest extent permitted by law. The Promoter reserves the right to: (i) permanently disqualify from the Competition any person it believes has intentionally violated these Terms and Conditions; and (ii) cancel, suspend and/or modify the Competition without any liability if any fraud, virus or other factor beyond the Promoter’s reasonable control impairs the administration, functioning or proper play of the Competition, as determined by Promoter in its sole discretion, and withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Competition), and to select winner from among all eligible entries received prior to withdrawal. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.
p) The Competition is in no way sponsored, endorsed or administered by, or in association with, Instagram or Facebook. Entrants are providing their information to the Promoter and not to Instagram or Facebook and by participating in the Competition you agree to a complete release of Instagram and Facebook from any claims .
q) Any complaints arising out of the Competition or these Terms and Conditions shall be sent to [email protected]
r) The Promoter shall comply with its obligations under the terms of any applicable data protection legislation, including but not limited to Regulation (EU) 2016/679 (“GDPR”), the UK Data Protection Act 2018; and the EU Privacy and Electronic Communications Directive (2002/58/EC), each as transposed into domestic legislation and in each case as amended, replaced or superseded from time to time, and any other relevant data protection laws, legislation and regulation.
s) Entrants’ details will be processed in accordance with the Promoter’s Privacy Policy, available at https://www.drmartens.com/de/de/privacy and will be securely deleted 30 days after the Competition ends, unless entrants’ opt in to receiving relevant communications in the future.
t) The Competition and these Terms and Conditions and any dispute or claim arising out of, or in connection with them are governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction in respect of any dispute arising from the Competition and these Terms and Conditions.
