DR. MARTENS PRIDE COMPETITION (THE “COMPETITION”)

 

TERMS AND CONDITIONS

 

a. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. By participating in the Competition, you (i) agree to be bound by these Terms and Conditions, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Promoter and its external decision makers (as defined below), which are final and binding in all matters relating to the Competition.

 

b. PROMOTER: Airwair International Ltd (registered company no. 03009359) whose registered office is at Cobbs Lane, Wollaston, Northamptonshire NN29 7SW (“the Promoter”) is the organiser of the Competition.

 

c. ENTRANCE: Entrants must follow all the online instructions for the Competition to be eligible to enter and win. To be eligible, entrants must fill out the form at https://www.drmartens.com/uk/en_gb/win-your-pride-design for a chance to win the prizes detailed at (f) below (the “Prizes”). This form will require the entrant to submit:

i. A medium-resolution design (a “Design”), which must be provided in .JPEG, .PNG or .PDF format. Entrants may add their Design to a .PDF template made available on the Promoter’s website (see https://www.drmartens.com/uk/en_gb/win-your-pride-design) but this is not a requirement for entry. This template does not reflect how the winning Design will be displayed in the windows of the Dr. Martens stores, and is for guidance only. Entrants must retain a high-definition copy of their Design as this will be requested from the winner once the winner is decided. This Design must be Pride-themed, and, if successful, will be used to promote local Pride celebrations across Europe. It should therefore be designed for this purpose (the “Purpose”);

ii. A brief summary of why the entrant wants to celebrate the LGBTQIA+ community; and

iii. The entrant’s email address and first and last names.

It is optional for entrants to tick the box to subscribe to the Dr. Martens newsletter and they may unsubscribe at any time. Opting into our newsletter or other marketing emails (or choosing not to do so) will not affect an entrant’s chance of winning.

 

d. INELIGIBLE ENTRIES: The Promoter will not accept Competition entries/data that are:

i. Generated by a script, macro or use of automated devices; or

ii. Completed by a third party or mass entries; or

iii. Illegible, have been altered, reconstructed, forged or tampered with; or

iv. Defamatory, indecent or otherwise would be likely to cause harm to the reputation of the Dr. Martens brand; or

v.Incomplete.

There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition.
 

e. COMPETITION PERIOD: The Competition runs from 18:00 BST / 19:00 CEST on 11th May 2021 until 22:59 BST / 23:59 CEST on 30th May 2021. Entries received after that date and time will not be considered.
 

f. PRIZES: The Prizes for winning the Competition are:

i. A cash prize of £3,000 or €3,000 (depending on the region the winner is resident in);

ii. A pair of 1461 Pride shoes shown at https://www.drmartens.com/uk/en_gb/p/26800001; and

iii. The winner’s Design to be used across Dr. Martens’ channels in Europe for a 2-week duration in Summer 2021 to celebrate Pride. This use will comprise incorporation of their Design into the window display of select Dr. Martens stores across Europe, further use in-store and on Dr. Martens’ digital channels, including social media.

The prize of the 1461 Pride shoes listed at (f)(ii) above (the “1461 Prize”) is subject to availability. The Promoter will offer a redeemable voucher equivalent to the value of the 1461 Prize should the correct size not be available. The Prizes are non-assignable and non-transferable except to a surviving spouse. The Prizes are not for resale. 
 

g. ENTRY CRITERIA / RESTRICTIONS: The Competition is open to residents of the UK, France, Germany and the Netherlands (the Participating Countries) aged 18+ only. Entrants must have a bank account registered in one of the Participating Countries, as the winner will be required to provide details of a bank account for payment of the cash prizes (as detailed in (f)(i) and (j)(ii)). Employees or agents of the Promoter, their family members, or anyone else connected with the Promoter or the promotion may not enter the Competition. By entering the competition, the entrant confirms that they are eligible to do so and eligible to claim the Prizes. The Promoter may require you to provide proof that you are eligible to enter the Competition.
 

h. WINNING THE COMPETITION: A shortlist of between 5 and 10 Designs chosen from all valid entries (the “Shortlist”) will be compiled internally by the Promoter, with the winning Design then being chosen from the Shortlist by an external 4-member jury, which will be comprised of individuals affiliated with regional LGBTQIA+ communities in Europe : Tarik Tesfu, Romain Costa, Naomie Pieter and Travis Alabanza.
 

i. The winner will be contacted in accordance with paragraph j) below no later than 22:59 GMT / 23:59 CEST on 4th June 2021.

j. The winner will be contacted via email. If a winner fails to respond by the deadline notified in that email, another winner will be selected from the pool of entrants with the eligible entries. For clarity, the winner must provide:

i. a high-definition version of their Design;

ii. their bank details for payment of the cash prizes (set out in (f)(i)); and

iii. their shoe size and delivery address,

within 48 hours from the time the email is sent by the Promoter in order to win the Competition and the Prizes. Provided the Promoter has received (and can access) the high-definition Design and the winner has complied with these Terms and Conditions, the Promoter shall pay the cash prize within 30 days of receipt of the winner’s bank details. The Promoter accepts no responsibility for incorrect or misspelt email contact information, bank details and/or delivery address submitted by an entrant and/or winner. No liability is accepted for entries that cannot be counted for any technical reason.

k. Subject to the winner’s approval, the surname and country of the winner will be available for 28 days after the closing of the competition by e-mail request to: [email protected].
 

l. INTELLECTUAL PROPERTY: By submitting a Competition entry, you warrant that:

i. you are the sole creator of the Design; and

ii. the Design is capable of being used for the Purpose without requiring the consent of any third party. 

You undertake to indemnify, defend and hold harmless the Promoter from and against any and all claims, costs, demands, liabilities, expenses, damages or losses (including all interest, penalties, and legal and other professional costs and expenses) as a result of your breach of this clause.

By submitting a Competition entry, you agree to the following terms:

i. in the event that your Design is the winning Design, you grant the Promoter a perpetual, irrevocable, sub-licensable, exclusive, royalty-free, licence to use the Design in association with Pride. This includes any use of the Design in or on (as applicable) any ‘Dr. Martens’ branded store, website and/ or social media account in association with Pride 2021 or any future Pride celebrations;

ii. in the event that your Design is included on the Shortlist but is not the winning Design, you grant the Promoter a perpetual, irrevocable, sub-licensable, royalty-free licence to use the Design on any ‘Dr. Martens’ branded website and/ or social media account in association with the Competition; and

iii. in the event that your Design is included on the Shortlist, you waive all moral rights in and to your Design and otherwise arising in connection with the Competition entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

For the avoidance of doubt, this clause shall survive termination of these Terms and Conditions.
 

m. GENERAL CLAUSES: The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside of its control. The Promoter may, at its sole discretion, reserve the right to exclude an entrant from the Competition if it has reason to believe that there has been a breach of these Terms and Conditions. The decisions of the Promoter and its external decision makers in all matters under its control are final and binding. The Competition will be governed by English law, and the parties submit to the jurisdiction of the courts of England and Wales.
 

n. The Promoter is not responsible if the Competition cannot take place or if the Prizes cannot be awarded due to cancellations, delays or interruptions due to acts of war (declared or undeclared), natural disasters, weather, acts of terrorism, riot or civil disturbance, satellite or equipment failure, federal state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within the Promoter’s control (each a “Force Majeure” event or occurrence).
 

o. The Promoter is not responsible for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Promoter on account of technical problems or traffic congestion on the internet or at any web site or any combination thereof; or (ii) any injury or damage to persons or property, including but not limited to death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use of the Prizes. Nothing shall exclude or limit the Promoter’s liability for death or personal injury as a result of negligence or fault, or any other liability that cannot be excluded or limited by applicable law. 
 

p. Behaviour which is intended to disrupt or undermine the legitimate operation of the Competition, or which is intended to annoy, abuse, threaten or harass any other person, or any failure to comply with these Terms and Conditions, may result in disqualification from the Competition, and the Promoter reserves the right to seek damages and other remedies from any such person engaging in such behaviour to the fullest extent permitted by law. The Promoter reserves the right to: (i) permanently disqualify from the Competition any person it believes has intentionally violated these Terms and Conditions; and (ii) cancel, suspend and/or modify the Competition without any liability if any fraud, virus or other factor beyond the Promoter’s reasonable control impairs the administration, functioning or proper play of the Competition, as determined by Promoter in its sole discretion, and withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Competition), and to select winners from among all eligible entries received prior to withdrawal. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.
 

q. Entrants’ details will be kept in accordance with the Promoter’s Privacy Policy, available at https://www.drmartens.com/uk/en_gb/privacy. Entrants’ details will be kept only for the purposes of the Competition.
 

r. These Terms and Conditions are subject to and shall be governed by and construed in all respects in accordance with English law and the parties hereby submit to the exclusive jurisdiction of the English courts.
