Terms & Conditions – Dr. Martens Instagram Reels Remix (the “Competition” ).

a)  NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. By participating in the Competition, you (i) agree to be bound by these Terms and Conditions, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Promoter (as defined below), which are final and binding in all matters relating to the Competition.

b)  Airwair International Ltd (registered company no. 03009359) whose registered office is at Cobbs Lane, Wollaston, Northamptonshire NN29 7SW (“the Promoter”) and We Are Social Ltd (registered company no. 06629464) whose registered office is at Alphabeta, 14-18 Finsbury Square, London, England, EC2A 1BR (“the Agency”) are the organisers of the Competition.

a)  Entrants must comply with these Terms & Conditions to be eligible to enter and win. To be eligible entrants must:
i. create a video to Cariss Auburn’s (“the Artist”) track “Daydream” (“the Entrant Video”);
ii. select the ‘remix’ reel function on Instagram for the Dr. Martens Instagram reel featuring WondRWomN (“the Influencer”) on the @drmartensofficial Instagram;
iii. upload their Entrant Video to the Instagram App remixing the Dr. Martens reel; (“the Reel Remix”); and

the Reel Remix must be shared to the entrant’s own Instagram page with the hashtags #TeamUpOnTheTrack & #ToughAsYou. Entry into the Competition is not conditional on providing a specific video and every entrant that complies with these Terms and Conditions is eligible to enter. The Winner will be chosen based on who the Artist and Influencer deem best demonstrates their creativity via use of the ‘remix’ reel function. Accounts must be public for the duration of the Competition so that Promoter can contact winners.

b) A prize of GBP £5000.00 (or equivalent) will be given away to one (1) entrant ("the Winner"), chosen by the Artist and the Influencer, and payable by the Agency. Any tax obligation that arises as a result of the granting of the prize will be the sole responsibility of the Winner and neither the Promoter nor the Agency will be liable in respect of any such tax obligation. Entries which are defamatory, discriminatory, obscene, abusive, threatening or offensive in any way shall be excluded from the Competition. The Artist and Influencer’s decision is final.

c) One (1) entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. Competition begins at the time it is announced on the @drmartensofficial Instagram page on 4th January 2022. Entries will be accepted up until 11:59pm (GMT) on 7th February 2022. Entries received after that date and time will not be considered.

d) Winners will be contacted in accordance with paragraph f) below no later than 11:59pm (GMT) 28th February 2022.

e) The Competition is open to residents of the UK, European Economic Area (excluding Italy), Hong Kong, South Korea, Japan, Australia, New Zealand and the United States. Entrants must be aged 18+ to be eligible.

f) Winners will be contacted via direct message on Instagram by the Promoter. If a winner fails to respond by the deadline notified in that message another winner will be selected from the pool of entrants. No liability is accepted for entries that cannot be counted for any technical reason.

g) Subject to the Winner’s approval, the surname and email address of the winners will be available for 28 days after the closing of the competition by e-mail request to: [email protected].

h) Employees or agents of the Promoter, the Artist or the Influencer, their family members, or anyone else connected with the company or the events themselves may not enter the Competition.

i) By submitting a Competition entry, entrants irrevocably grant to the Promoter a royalty-free, sub-licensable, transferrable, perpetual licence to use their Reel Remix for any purpose throughout the world, including the right to use the name, image, voice and likeness of any individuals featured in the Reel Remix. This includes Airwair’s own PR or marketing purposes, online, in print on social media and for archive purposes. The Promoter is permitted to edit and make any alternations it chooses to the Reel Remix. The entrant may not grant a licence to use the Reel Remix to any third party without obtaining the prior consent of the Promoter. The Promoter expressly consents to permitting the entrant to enter into such licences as are necessary to submit their entry in accordance with the instructions in this agreement.

j) By entering the Competition, entrants confirm that the Reel Remix provided is entirely their own work and has not been copied from another source or infringe the rights of any third party.

k) The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside of its control. The decision of the Promoter in all matters under its control is final and binding. The Competition will be governed by the law of England and Wales.

l) The Promoter is not responsible if the Competition cannot take place or if the prize cannot be awarded due to cancellations, delays or interruptions due to acts of war (declared or undeclared), natural disasters, weather, acts of terrorism, riot or civil disturbance, satellite or equipment failure, federal state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within the Promoter’s control (each a “Force Majeure” event or occurrence).

m) Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Promoter is not responsible for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Promoter on account of technical problems or traffic congestion on the internet or at any web site or any combination thereof; or (ii) any injury or damage to persons or property, including but not limited to death, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use of the prize, except where such liability cannot be excluded by applicable law.

n) Behaviour which is intended to disrupt or undermine the legitimate operation of the Competition, or which is intended to annoy, abuse, threaten or harass any other person, or any failure to comply with these Terms and Conditions, may result in disqualification from the Competition, and Promoter reserves the right to seek damages and other remedies from any such person engaging in such behaviour to the fullest extent permitted by law. The Promoter reserves the right to: (i) permanently disqualify from the Competition any person it believes has intentionally violated these Terms and Conditions; and (ii) cancel, suspend and/or modify the Competition without any liability if any fraud, virus or other factor beyond the Promoter’s reasonable control impairs the administration, functioning or proper play of the Competition, as determined by Promoter in its sole discretion, and withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Competition), and to select winner from among all eligible entries received prior to withdrawal. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

o) The Competition is in no way sponsored, endorsed or administered by, or in association with, Instagram. Entrants are providing their information to the Promoter and not to Instagram and by participating in the Competition you agree to a complete release of Instagram from any claims.

p) Any complaints arising out of the Competition, or these Terms and Conditions shall be sent to [email protected]

q) The Promoter shall comply with its obligations under the terms of any applicable data protection legislation, including but not limited to Regulation (EU) 2016/679 (“GDPR”), the UK Data Protection Act 2018; and the EU Privacy and Electronic Communications Directive (2002/58/EC), each as transposed into domestic legislation and in each case as amended, replaced or superseded from time to time, and any other relevant data protection laws, legislation and regulation.

r) Once a winner has been selected, personal information will be collected in order to award the prize. The winners’ details will be processed in accordance with the Promoter’s Privacy Policy, available at https://www.drmartens.com/uk/en_gb/privacy.

s) The Competition and these Terms and Conditions and any dispute or claim arising out of, or in connection with them are governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction in respect of any dispute arising from the Competition and these Terms and Conditions
